1. Nature of the Platform & Commercial Scope
MarineListing.com ("Platform") provides digital discovery, technical taxonomy indexing, commercial RFQ broadcasting, and direct matchmaking between commercial vessel operators (shipowners, technical superintendents, fleet managers) and verified maritime suppliers (ship repairers, OEM distributors, marine electronics technicians, and ship chandlers) across 6,297+ ports worldwide.
2. Zero Broker Commission & Commercial Transparency
MarineListing charges 0% broker commission on contracted commercial transactions, spot requisitions, drydock tenders, or spare parts deliveries awarded between buyers and suppliers. Revenue is generated solely through optional supplier subscription memberships (e.g., Port Specialist, Regional Leader), verified directory sponsorships, and platform access services as defined in our public pricing matrix.
3. Buyer & Vessel Operator Terms
- Free Requisition Posting: Vessel operators, ship superintendents, and fleet managers may post commercial RFQs, technical tenders, and spares requisitions 100% free of charge.
- Accuracy of Specification: Requisition submitters agree to provide truthful vessel details (including vessel IMO number, target port or anchorage, required delivery schedule, and technical specifications) to enable accurate supplier quotation.
- Commercial Quotation Review: Submitting an RFQ does not obligate the vessel operator to award a contract to any quoting contractor.
4. Supplier, Contractor & OEM Obligations
- Verification Credentials: Suppliers submitting credentials, manufacturer authorizations, or Classification Society approvals warrant that all uploaded licenses, survey passes, and certificates are genuine, current, and issued by recognized maritime authorities.
- Independent Quotations: All commercial quotes, delivery lead times, and terms submitted via the Quotations Desk constitute independent commercial offers directly from the supplier to the buyer.
- Regulatory Compliance: Contractors attending vessels at berth or anchorages must comply with local port authority regulations, ISPS Code requirements, and Class survey rules.
5. Limitation of Liability
To the maximum extent permitted by applicable maritime law, MarineListing, its directors, and technical operators shall not be held liable for any commercial disputes, delays in port turnaround, off-hire penalties, demurrage, cargo contamination, equipment failures, personal injury, or incidental damages arising from contracts executed between third-party buyers and suppliers introduced through the platform.
6. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with English Maritime Law and international maritime commercial arbitration standards. In the event of a commercial dispute between platform users, parties agree to seek amicable resolution through good-faith negotiation before initiating formal legal proceedings.
